£5,600 hearing loss compensation is awarded to a West Midlands toolmaker.

A toolmaker who operated machinery for two West Midlands engineering firms is awarded a payout for NIHL and tinnitus.

Claim case details:

An engineering machine operative who worked for a period covering 3 decades has recently won a payout.

He began work over 30 years ago as an apprentice toolmaker for a firm of engineers in the West Midlands. During the course of his employment, he carried out various noisy processes such as drilling and grinding.

One particular process required him to machine large steel rods, the noise while he carried out his job was excessive. He was unable to communicate with colleagues working on nearby machines as the collective noise was so great that they couldn't hear each other and had to communicate by using hand gestures.

Health and Safety failings.

During the time he worked in a noisy environment his employer failed to warn him of the risk of hearing damage, or provide him with ear defenders. His employer failed to follow Health and Safety guidelines and so failed in their duty of care.

After leaving his first employer he went to work at a second engineering firm. His job required him to operate drills, grinders, milling machines and presses. He also operated 'multi-machines' which carried out a number of different process simultaneously creating a high level of noise.

At the start of his employment in spite of the excessive level of noise he was not provided with ear protection or advised of the risk to his hearing. After the first few years ear plugs were made available, but supplies often ran out meaning none were available.

His hearing loss was gradual, and as well as noticing a deterioration in his hearing he also started to experience a high pitched ringing in his ears.

On examination it was shown he was suffering hearing damage which was directly linked to the work he carried out for his previous two employers.

He decided to make a claim for compensation and a settlement of £5,600 was agreed for NIHL and tinnitus.

What to do if you have work related hearing loss.

If you have begun to notice a reduction in your ability to hear or have begun to notice a ringing or buzzing in your ears, make an appointment for a hearing examination.
